Generally, work related accidents are covered exclusively by workers’ compensation benefits which prevents employees from suing their employers for negligence. However, there are important exceptions. If an employee is injured in the result of a “height related” accident, such as: a fall from a ladder, a scaffold, or falls into a pit, they can sue the general contractor and owner of the property. These cases can result in very high verdicts and settlements because of the ample amount of insurance coverage available in these cases. Additionally, if an employee can sue a third party, other than the employer, for negligence then they may bring a third party lawsuit.
